This Personal Data Protection Notice has been prepared to inform natural persons who visit the www.asuka.com.tr website, use the contact and quotation forms, request products and technical documents, benefit from B2B services, or establish or wish to establish a commercial relationship with Asuka Kimya, about the purposes and legal grounds on which their personal data is processed within the scope of the Personal Data Protection Law No. 6698.

Messages sent through the contact forms, product information requests, price quotation requests, technical support requests, document requests, complaints and other correspondence.

B2B Usage Information

B2B user account information, user transactions, order movements, document requests and account usage records.

Transaction Security Information

IP address, date and time of access, session and security records, error logs, system access logs and technical records kept for the purpose of ensuring the security of the website.

Legal Transaction Information

Information and correspondence relating to legal proceedings where requested by authorized public institutions or judicial authorities.

Personal data is processed in a manner that is connected to, limited to and proportionate with the purpose.

4. Legal Grounds for Processing Personal Data

Your personal data is processed based on the personal data processing conditions set out in Article 5 of the KVKK.

In this context, personal data may be processed on the legal grounds that;

  • it is expressly provided for by law,
  • it is directly related to the establishment or performance of a contract,
  • it is mandatory for the data controller to fulfil its legal obligation,
  • data processing is mandatory for the establishment, exercise or protection of a right,
  • data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

In cases where explicit consent is required, the explicit consent of the data subject is obtained separately.

Through the contact form on the website, your name-surname, e-mail address and, if entered by you, telephone number may be collected.

This information is processed for the purpose of evaluating your request, directing it to the relevant unit and contacting you.

7. Quotation, Product and Document Requests

If you make a request via the website for;

  • a price quotation,
  • product information,
  • stock information,
  • a sample,
  • COA,
  • SDS,
  • TDS,
  • specification,
  • technical documentation,

your contact and company information may be processed for the purpose of fulfilling the request.

8. B2B System

When the B2B system is used, personal data may be processed within the scope of account creation, user verification, product and price viewing, order creation, order tracking, document access and customer support processes.

9. Transfer of Personal Data

Your personal data may be transferred, limited to the processing purposes, to;

  • authorized employees,
  • relevant company departments,
  • information technology and software service providers,
  • hosting and infrastructure service providers,
  • accounting and finance service providers,
  • cargo and logistics companies,
  • parties from whom legal and consultancy services are received,
  • business partners and suppliers where necessary,
  • legally authorized public institutions and organizations,

within the framework of the conditions set out in the KVKK.

10. Transfer of Data Abroad

If the transfer of personal data abroad becomes necessary because the infrastructure of services such as cloud computing, e-mail, analytics, software, security or similar is located abroad, the transfer is carried out in accordance with the KVKK and the applicable relevant legislation.

12. Storage of Personal Data

Personal data is stored for the periods stipulated in the relevant legislation or for the period required by the purpose of data processing.

Upon expiry of the storage period and when the legal reason requiring the processing of personal data ceases to exist, the data is deleted, destroyed or anonymized in accordance with the legislation.

Asuka Kimya implements the necessary technical and administrative measures to prevent the unlawful processing of and access to personal data and to ensure the safekeeping of personal data.

14. Your Rights Under the KVKK

Within the scope of Article 11 of Law No. 6698, you have the right to;

  • learn whether your personal data is being processed,
  • request information if it has been processed,
  • learn the purpose of processing,
  • learn whether it is used in accordance with its purpose,
  • know the third parties to whom it has been transferred domestically or abroad,
  • request the correction of incompletely or incorrectly processed data,
  • request its deletion or destruction where the legal conditions are met,
  • request that the correction or deletion operations be notified to the third parties to whom the data has been transferred,
  • object to the occurrence of a result against you as a result of analysis carried out exclusively through automated systems,
  • request compensation for the damage in the event that you suffer damage due to unlawful processing.
